Terms of Sale

Seller and scope

The seller is Ascalon Group d.o.o., Vojvode Putnika 34, Beograd, Registration no. 68417112, Tax ID 115503933, registered with the Serbian Business Registers Agency (APR). Contact: [EMAIL].

These terms apply to the purchase, commission sale and sale of items of value. IT services and business consulting are agreed in individual written contracts, to which these terms do not apply.

Items we do not deal in

We do not buy, take on commission or sell items whose sale is prohibited or requires a special licence, such as:

• weapons, ammunition and their parts;
• protected cultural property;
• precious-metal articles without the required hallmark;
• items whose ownership or lawful origin cannot be proven.

Purchase of items

• Before a purchase we establish the seller's identity from an identity document and keep a copy of it with the data we do not need blacked out.
• The seller proves ownership of the item (invoice, contract or other evidence) or signs a written statement that they own it and that it is free of third-party rights.
• The purchase is concluded by a written contract stating the description and condition of the item and the purchase price.
• The purchase is final. We offer no buy-back right; a purchase is not a loan and the item is not pledged.
• The purchase price is paid to the seller's bank account within the period stated in the contract.
• We may refuse a purchase without giving reasons, in particular where ownership or origin is not proven. We report a well-founded suspicion of a criminal offence to the authorities.

Commission sale

Under a written commission agreement we sell the item in our own name and for the account of its owner (the consignor).

• On receipt we draw up a receipt record with the description, condition, photographs and agreed value of the item.
• The commission, the minimum sale price, the term of the agreement and the payment period are set in the commission agreement.
• We keep the item with the care of a prudent businessperson and are liable for its damage or loss up to the value stated in the receipt record.
• Where the item is sold at a distance, the consignor is paid after the buyer's withdrawal period has expired.
• The consignor collects an unsold item within the period and on the terms set in the commission agreement.

Prices and payment

Prices are in Serbian dinars and are final. Ascalon Group d.o.o. is not registered for VAT, so no VAT is charged.

Payment is made by transfer to our bank account. We issue a fiscal receipt for every sale.

Buying at a distance

When a contract is concluded without both parties being physically present (agreed by phone or email), before it is concluded we send you the description and condition of the item, the final price, the delivery costs, the payment and delivery terms, these terms and the withdrawal form. The contract is formed when we send you its written confirmation by email.

Delivery

You can collect the item in person at our premises, or we send it by courier, as agreed. Delivery costs are stated before the contract is concluded. We deliver within the agreed period and no later than 30 days after the contract is concluded. The risk of accidental loss of or damage to the item passes to you when the item is handed over to you.

Right to withdraw from a distance contract

• You may withdraw from a distance contract within 14 days of the day you received the item, without giving a reason.
• You withdraw using the form on this page or any other clear statement sent to [EMAIL] or to our address.
• You return the item without delay and no later than 14 days after sending the withdrawal statement. You bear the direct cost of returning the item.
• We refund the amount paid, including delivery costs, without delay and no later than 14 days after receiving your withdrawal statement. We may withhold the refund until we receive the item or proof that it has been sent.
• You are liable for any reduction in the item's value caused by handling it beyond what is necessary to establish its nature, characteristics and functioning.

There is no right of withdrawal when you buy the item at our premises.

Conformity and liability for defects

We are liable for the conformity of the item with the contract in accordance with the Serbian Consumer Protection Act. For used items a period of one year from delivery is agreed; for new items the period is two years.

The condition of the item, including signs of use and damage, is stated in its description and in the contract. We are not liable for defects we told you about before the purchase.

If the item does not conform, you have the right to have the non-conformity remedied, to an appropriate price reduction or to terminate the contract, as provided by law.

Complaints

You can make a complaint in person at our premises, by phone, by email to [EMAIL] or by post, with proof of purchase (receipt or contract). We confirm receipt, keep a record of complaints, reply within 8 days of receipt at the latest and resolve the complaint within 15 days of its submission at the latest.

Out-of-court dispute resolution

If we cannot settle a dispute by agreement, as a consumer you may start out-of-court consumer dispute resolution before a body on the list kept by the competent ministry. We are obliged to take part in that procedure. This does not limit your right to go to court.

Withdrawal form
